Terms of Service

Version effective as of September 16, 2026

These Terms of Service (hereinafter — the "Agreement") govern the relationship between Spharma LLC (hereinafter — the "Company") and the user of the SpharmA mobile application (hereinafter — the "Application").

1. General Provisions

• Use of the Application constitutes the User’s full agreement with the terms of this Agreement.
• The Company reserves the right to modify the terms of the Agreement. The current version is always available at SpharmA.uz.
• The Application is intended for searching, ordering, and purchasing pharmaceutical products and related goods through SpharmA pharmacy network outlets in the Republic of Uzbekistan.

2. Registration and Account

• To use the Application, registration is required by providing an active phone number.
• The User is responsible for maintaining the confidentiality of their login credentials.
• Each user may have only one account.
• The Company reserves the right to block an account in case of violation of the terms of the Agreement.

3. Orders and Payment

• The seller of the goods is Spharma LLC. Retail sale of medicines and medical devices is carried out under pharmaceutical activity licence No. 305417 issued by the Ministry of Health of the Republic of Uzbekistan (valid June 24, 2024 — June 24, 2029). Orders are dispensed and handed over by SpharmA network pharmacies.
• Prices are stated in Uzbek soum (UZS) inclusive of all applicable taxes and may vary between network pharmacies. The total order amount is displayed before the order is confirmed.
• Orders can be paid online by bank card via the Payme payment system, in cash on receipt, or partially or fully with loyalty programme points.
• The User may save a card for future payments. In that case the Company stores the payment token and the masked card number in encrypted form; the full card number and CVV/CVC code are not stored. A saved card can be deleted in the Application at any time.
• An order is considered placed after confirmation by the SpharmA network pharmacy. The terms on which the contract is concluded are set out in the Public Offer.
• Prescription-only medicines are not sold through the Application — they cannot be added to an order. Such medicines can be purchased only in person at a network pharmacy upon presentation of a valid prescription.

4. Delivery and Pickup

• Delivery is carried out to the address specified by the User, or through self-pickup from the pharmacy.
• Delivery times depend on product availability and the location of the partner pharmacy.
• The Company is not liable for delivery delays caused by force majeure circumstances.
• Delivery zones, timeframes, costs, and self-pickup rules are set out in the Orders & Delivery Policy. Order cancellation and refund procedures are set out in the Refund Policy.

5. Loyalty Program

• Users may participate in the SpharmA loyalty program by accumulating bonus points on purchases.
• Points may be used for partial or full payment of subsequent orders.
• The terms of points accrual and redemption are determined by the loyalty program rules.
• The Company reserves the right to modify the terms of the loyalty program with prior notice to Users.

6. Limitation of Liability

• The Company provides a platform for connecting Users with SpharmA pharmacy network outlets and is not responsible for the quality of pharmaceutical products.
• Drug information in the Application is for reference purposes only and does not constitute medical advice.
• The User must consult a physician before using any pharmaceutical products.
• The Company is not liable for losses arising from improper use of the Application.

7. Intellectual Property

All materials in the Application, including design, logos, texts, and source code, are the intellectual property of Spharma LLC and are protected by the legislation of the Republic of Uzbekistan.

8. Account Deletion

• The User may delete their account at any time through the Application settings.
• Upon account deletion, all personal data is removed in accordance with the Privacy Policy.
• Unused bonus points are forfeited upon account deletion.

9. Applicable Law

This Agreement is governed by the legislation of the Republic of Uzbekistan. All disputes shall be resolved through negotiations, and if an agreement cannot be reached, through judicial proceedings in accordance with the legislation of the Republic of Uzbekistan.
